I think what type of negligence is important medical, legal, accounting? As you need a solicitor who is familiar with the right type of case.

HermioneMakepeace · 26/12/2020 10:26

@Lonecatwithkitten it’s real estate.

Some house insurance legal cover covers negligence - if you have it give them a ring ?

HermioneMakepeace · 26/12/2020 17:06

Thanks, but it’s a litigation case.

Have you been through the firm's complaints procedure? If not that is the first step. If you have and you aren't happy with the outcome then you need to speak to a solicitor who specialises in land and property law and take their advice first. Just because you think someone has been negligent doesn't actually mean that they have so be very careful. If your new solicitor has confirmed that you have a case then they should be able to refer you to a litigation solicitor who has the necessary field of expertise.

I haven’t been through their complaints procedure, but they’re a Fortune 500 company so they must have one. Do you think it’s worth the time and trouble?

You have to start with their complaints procedure. Give them a chance to review what was done and confirm whether they feel you have any grounds for complaint. If they don't find in your favour and the issue cannot be rectified by them (whatever it is) then you can then seek to take matters further.

@redastherose do you know if internal Complaints departments are ever able to award compensation, in theory?

The internal complaints dept should be able to award compensation / put right any error. If you aren't happy with the result there may be an ombudsman service you can take your complaint to depending on what the complaint relates to. They can also order the company to pay compensation etc

HermioneMakepeace · 28/12/2020 07:40

@Doveyouknow thank you. Do you know if that could include compensation for distress caused, or just financial loss? Obviously in theory.
