Neighbours right to have my address

Justpassingtime1 · 25/12/2020 06:44

I live in flats and have lived there for years always paying my share.
Recently there is a Buy to let landlord below who we rarely see .
He does not give us his address .
I recently rented out my flat and have been pestered relentlessly
for my new address. Again I have paid my fair share.
They have contact details otherwise I have also offered to attend
face to face meetings which have been refused.
What are my rights re giving my address?

I'm surprised that if you don't know the legalities, that you're not using letting agents. Have you not given your tenants a proper, legal tenancy agreement? You will see on there that there is a requirement to give your address. (I'm not quite sure why you think the landlord of the flat below should give you his address).

Presumably you know that the deposit which your tenants pay should be paid to, and registered with, one of the government approved companies registered to hold deposits? Failure to do so could result in you being fined 3x the amount of the deposit. Go and take proper legal advice and do it properly OP.

Who wants your address?

SoupDragon · 25/12/2020 06:56

If the neighbours have "contact details" and can contact you if necessary, I don't think they need your address.

xmasfairybuns · 25/12/2020 06:59

My tenants do not have my intact details just those of the estate agent, they can be contacted 24/7/365 in an emergency. Yanbu as long as you have that in place.

ChardonnaysPetDragon · 25/12/2020 06:59

Landlord details are needed for Universal Credit.

Your post is slightly confusing. By law in England (and probably the rest of the UK) landlords must give their tenants their address. If someone is your neighbour surely they know your address because it's the same as theirs plus or minus a few numbers?

If you are in England the you are breaking the law, even if you use an agent. Your agent may have passed your address onto your tenant on your behalf.

If you're in the uk your tenants have a right to have your contact details
xmasfairybuns · 25/12/2020 07:34

I'm sure they have, it's a national chain of well known estate agents. My tenants never contact me though, it's all done through the agents and they have my authority to action urgent repairs if I can't be contacted for whatever reason.

ShalomToYouJackie · 25/12/2020 07:48

Who wants your address, your tenants? What's that got to do with the landlord downstairs? Why do you want his address?

And what's "paying your share" got to do with anything?

Ifailed · 25/12/2020 07:57

OP owns her flat, and pays a share of the management fee (though that is irrelevant).
a new owner has bought the flat below to rent out.
OP rents out her flat - her tenants are irrelevant.
new owner wants OPs address. Question is, does she have to give it?

Justpassingtime1 · 25/12/2020 08:47

Ifailed that's it! Of course my tenants have my details incl my address.
I have got tenants via reputable agent.
The other flatowners can contact me via text etc
The question is do they have the right to have my new address?

The other flat owners don’t have the right to your address. Ignore them.

Justpassingtime1 · 25/12/2020 09:09

yes Thanks That is what I thought.

Why do they want your address? They don't have the right to know it

LemonTT · 25/12/2020 14:23

Is this an issue associated with a leasehold?

PleasantVille · 25/12/2020 15:02

Of course random neighbours don't have a right to know your address. Is it something to do with paying the management fee, I'm not quite clear on what the situation is.

DianaT1969 · 25/12/2020 15:46

Why does the landlord below want your address? Is it to send you legal documents?

Ensure you update the land registry with your new address, or an address for service. Rented properties are easy targets for conveyancing fraud.

You must also ensure you provide an address for service to the freeholder or their managing agent. Failing to do so could result in legal documents for s20s, and forfeiture not reaching you which would be disastrous for you from a legal perspective.

Also ensure you have written permission to rent out the property. Breaching your mortgage conditions and being found out can leave you blacklisted, and actions for recovery of the property, so you will be unable to obtain a mortgage in the future.

If you don't know these things you need to do some landlord training.
