Fact finding hearing, what happens now?

Tomorrow is the last day of the fact finding hearing, how is the out come structured? And when will we hear the out come?

Ask your barrister what the timescale is. The judges verdict goes through to the final hearing.

I had a week fact find. Last day was a (long) summing up by the judge with his thoughts on all parties, then he read out each fact and said whether it was found or not.

Normally the judge reads out a sort of statement which sums up what they've heard and then what their views are. It's not a guilty/not guilty type of situation. It's usually within a week of final evidence but depends on court time, as obviously they need to be available to read it out.

Every case is different. When a case goes in someone’s favour, it can never be the same as another case. How can it be?

You can, at a final hearing, try and ensure any additional info is put forward. However judges will do what’s best for the child. There might be other professionals such as psychologists and CAfCASS who can be asked questions by barristers at final hearings. All of this is taken into consideration too. Your barrister will advise.

@Learningtobehappier I can't remember now, was a few years ago. My barrister and solicitor were happy that the judge we had often did criminal cases and not just family court.

The Judge probably won't give judgment on the final day if its a case more than a few days as he/she will need time to get their thoughts in order.

The standard of proof in family cases is 'balance of probabilities' which is quite low - but once a fact is found you are stuck with it, unless you appeal.

@Pebbledashery 12 out of 12, supervised contact but he didn't bother for that long. Not seen his child for 3 years.
