Does no road tax void insurance

Hi I was in a car accident earlier on today, I believe it was 50/50 but he is saying it was my fault. I've done some looking into it and his tax expired in February, does this then void his insurance. He claims he has only had the car 3 weeks but I thought the grace period for road tax ended when it went online. Please can anyone help

Agree with premiumhob - lack of road tax does not automatically invalidate insurance. However, from what you've said, I'm not clear that it matters.

If it was 50/50, as you believe, you are liable for 50% of the cost of fixing his car, he is liable for 50% of the cost of fixing your car. This will all be dealt with by your insurance company. They will cover any payment you have to make to him. If you have comprehensive cover, they will cover the cost of fixing your car even if they are unable to recover anything from him.

If he is right and it is your fault, your insurance company will pay for the damage to both cars regardless of the status of his insurance and road tax.

Go via your insurance company and they will sort it.

I work in insurance (very large) company. Not having road tax does not invalidate an insurance policy.
