Can anyone help me with this letter regarding Harvey’s?

So I bought a bed and sofa last year on finance, bought the extended warranty for the sofa as well. Beginning of this year there was a fault with the sofa. Booked engineer out to sort it out. Lockdown happened and they couldn’t come. Then they rebooked it and then cancelled it as told their had gone on administration. I have been chasing my tail with them. Told to email the company who were dealing with the administration. Was told warranty is not valid now.

Since then other things have gone wrong with the sofa. I have had a letter from price water something or other saying they are acting on Harvey’s behalf... talking about me being a creditor.. gave me log in details for some portal to make a claim.... but no one can tell me what I can claim?? I can’t buy a new sofa as the finance doesn’t end until 2022. More things keep going wrong with it and it’s starting to piss me off. Am I likely to be able to make any claim back against them??

The company I’m assuming is pricewaterhousecoopers( pwc for short). They are the biggest accountancy firm in the UK. You should be claiming for the entire original cost of the sofa plus any interest that you would pay through the finance deal to the end of its term (claiming as it’s faulty and you state you will return sofa) . They may not be able to give you that as there is a hierarchy of creditors under insolvency law ( which is what administrators come under). Unsecured creditors such as yourself come last in the hierarchy. You may end up with nothing, a couple pennies in the pound, or you may end up with the full amount back and the sofa taken off you (then you can get another with someone else. Who is the finance deal with ie What legal entity name of a finance company does it say on your paperwork?

The finance is through creation? Although there is some other name also on it but paperwork is downstairs and I’m in bed and don’t want to wake dc so will check tomorrow. They are still available as I rung them today to find out how much finance I had left etc

It could be a while. It depends on how many creditors Harvey’s have and how well their books were kept, as well as who further up the hierarchy of creditors eg their bank if have a secured loan, wants to make a compromise to settle quickly. Creation unfortunately are a separate company so I think you need to keep paying them sadly, maybe someone else can advise on that but.

Thanks for replying. I had never used Harvey’s before, always bought more expensive sofas but decided to use them as I was in there buying a bed through bensons. Biggest purchase regret for years!

I don’t know? What would it cover me for @TheQueef? It’s a 0% credit agreement? I just pay it on a direct debit?

I'm thinking section 75 protection like what we have on credit cards.
I'm not certain but I thought it applied to all finance.
Is it worth spending £40 to join Which legal? I know they don't write letters for you but the advice might be worth it in case you can reject to finance company.

It says nothing in my paperwork with them about the company going into administration.... I have submitted a claim through PWC today...

I would try for a full refund if possible from the credit provider Creation.

Reason being unfit for intended purpose.

Yes that’s exactly what I have put. Finance doesn’t end until July 2022!!!! I don’t have the money to pay it off either or pay for 2 sofas at the same time. Each day something else goes wrong with it (some plastic bit underneath has now snapped off) nothing we have done, they are electric recliners and really starting to piss me off as they are cosmetically nice sofas so I’m really annoyed they won’t last!

If you don't get better responses here, hopefully someone will know if they are jointly liable.
Try Which it will give you confidence to pursue it.
