Selling house took out downstairs toilet and didn't replace

We bought a property in 2008 which required a lot of renovation and included a small toilet and sink next to the then small kitchen which was leaking. In 2008 we renovated to take out small leaking toilet and put new bigger kitchen in. Never added back a toilet.

Now just selling and I've looked up for the forms (not got them yet) and seems like building regs are if you remove a downstairs toilet and sink you must add one back of at least same size and get building regs to sign off. I just realised this today and not said anything yet until I work out best course of action. Replacing the bathroom would cause delays and would be very expensive so would prefer not to do that. An indemnity policy looks like a good option. It looks like we or buyer should not alert council though as its 10 years plus ago don't think they would do anything but would render indemnity useless.

Do we need to put we took out downstairs bathroom on the TA6 form? What's the best way of handling this - tell our solicitor, the EA? Pre-warn them or wait to see if survey finds. They are using an online cheap solicitor so wouldn't be amazed if just having a valuation survey but the plans for the extension show a bathroom though not the one that was there when we bought it a bigger one with shower which I think was never put in. Thanks very much.

You will need to declare this on the TA6. Section 4 asks some specific questions. If you fail to answer the questions that will raise a huge red flag to their solicitor. If you lie and the buyers find out after the sale has gone through, they could take action against you for misrepresentation.
