Drive way cross over

Hi the council are replacing all the paving and kerbs on our street , last week an inspector knocked on my door & told me that our cross over had never been approved by the council . We bought the house 9 years ago & the drive was there , the inspector had told me that if I use my drive by going over the cross over I’m breaking the law. My oh has delved deep and a drive has always been there we just thought it had been approved previously . Has anyone been through this ? Any advice we did apply for an application a couple of weeks ago

We bought a new house which needed us to cross over a privately owned lane to access, the ownership of which was unknown. Our solicitor got us an insurance indemnity meaning we had right of way over it. I would go back to your solicitor who did the legal work as it sounds like they may have overlooked this.

If you mean the kerb isn't lowered then the inspector is right. You can be billed for the cost of repair. You can also apply for the kerb to be lowered. The council will do the work (if it is approved) and bill you for the cost.

There are 2 parts to a dropped kerb to access a private driveway.

The actual physical work to lower the kerb and make the highway good.

The administrative process to approve the above.

If a house is bought without the latter, then irrespective of the former, there is no access to the drive.

That said, I'm impressed a cowboy job has lasted 9 years. 9 days is usually too much to hope for.

Do you mean it's had a dropped curb fired without the correct approval?
