Section 75 refund & disposal of hoods

Hello, I posted about 6 months ago and received some very helpful advice.

I am pleased to report that the credit card provider has approved the refund. They told me to give the company another deadline to collect the goods. They will refund once paperwork has been processed their end. They are considering consequential losses.

I contacted the company yesterday and gave them (another) 7 days. They replied today saying they had not heard back from the credit card company and their stance has not changed.

At this stage I have no desire to keep giving deadlines. I cannot physically return the item myself as it arrived on a pallet.

I am seeking confirmation that legally I can dispose of it?I will need to pay someone to dismantle it and take it to a tip.

I forgot to ask the bank, do they just suck up the cost or will they now expect to be reimbursed from the company? I know it makes no difference to me, I am just curious.

You can't just throw it all away. Look at this Act www.legislation.gov.uk/ukpga/1977/32. Read s12 and take it from there.

The bank will automatically do a charge back to the company.

@Collaborate thanks for the information. However I must be dense as I still don’t understand. I have written, emailed and called them since March asking them to collect their large and bulky item. It was very expensive so I haven’t thrown it out but I no longer have any place to reasonably store it. It has been in the way for 7 months - how much longer do I need to give them?

They have responded and have refused to collect it - it’s not as though I have been unable to contact them.

I appreciate it's not easy to follow but you'll just have to wade through it, otherwise you may have to pay for the goods after all. In a nutshell you must give them formal notice under the Act and then obtain best reasonable price for them on sale, and after deducting your sale costs you must account to them for the balance. Look at landlord forums. They have to deal with this all the time.
