"Ransom Strip"

20cm "ransom Strip" ( presume it's this as not in title deeds ). Presume it's being retained by the builders ( 9 year old house ). Causing delays and frustration as solicitors seem to be at loggerheads. It's in-between 2 houses at the side of the neighbours house but within boundary of property I'm buying ( I think ). Advice? Will a Stat Dec cover this?

Ok, sorry, but really; if your solicitor doesn't know this stuff you really need to dump them and find someone else.

But you’ve been given legal advice and you shouldn’t have to be doing this because your conveyancer should be doing it for you. That is what you are paying them for. They examine the title to make sure you’re going to own what you think you’re buying and if you need to access someone else’s property to get to yours, they need to make sure that your title has the requisite rights included in it. This shouldn’t be as complicated as it may seem. You’ve found out who owns the land so it’s registered. It’s up to your conveyancer to sort out if it’s going to be an issue. The only thing you should be doing with the information is getting your conveyancer to explain it to you. We can’t tell you the significance of the strip without seeing title plans and accompanying deeds. Leave the conveyancing to the person you are paying. Once it’s all been explained to you then you can decide if you want to proceed or not. You don’t have to buy this property if you don’t want to.

Also, you know the exact location of the strip as you’ve got (I presume) the title plan and if it’s excluded from your property ie not included within your title then the seller’s solicitor doesn’t have to give you information about it as your not buying it. If it’s a strip of land between two properties that does not prevent access to the property then it’s probably not a ransom strip.

No, the vendors have shown it to be where they think it is. My solicitor has asked the vendors solicitor for legal confirmation on exactly where it is as the title plan is not clear. My solicitor asked them to do this on 14tj August but they've Yet to give a FULL answer. And here we are OVER a MONTH later and no further forward

Does the title plan you downloaded not show you where this bit of ground is, though? The vendors won’t tell you exactly where the ground is because they don’t know and they’re not going to legally commit to covering that may come back to bite them later. You’d need a specialist surveyor to go to the property to physically measure out on the ground where the boundary is. Even then, whatever they say would be caveated ie they’re not going to want to commit definitely to who owns the ground. This is either being blown out of proportion or it’s too big a problem to solve quickly or cheaply. This is not the sort of problem that goes with a quick exchange. You’ve either got a boundary or an access issue. If it’s not sorted out now then you’re going to have the exact same problem when you cover to sell.

Nobody on here can give you the information you are asking for because we do not have the benefit of the land registry documents and details therein.

You are paying a conveyancer for their expertise in conveyancing matters and it is to them you need to direct your questions.

No. It says "between point A and pont B" yet the vendors tell me it's in another location so my solicitor has asked theirs to confirm. Still waiting for non vague answers. Obviously I WILL get these eventually but just wanted some legal bods thoughts as they may have come across similar previously

without seeing the title plan and document and probably a whole host of other information as well.

Sounds like your solicitor is being very thorough which I woykd say is a good thing. You need to know what you are buying and if it might prove a problem when you sell again
