Consumer Act - right to refund

I'll try and make this short (I hope!)

We purchased 2 high end gaming PCs in March for the DCs from their inheritance from their nan. Its a company that specialises in gaming PCs.

They both arrived with a broken graphics card. The company sent out a new card which we then installed.

They then both worked fine for a couple of months and then one broke - the operating system just completely stopped working. It was sent in for repair and returned to us about 6 weeks ago. 2 weeks ago it broke again with what appears to be the same problem.

The other PC also broke although with a different problem. It was sent back to them and has returned unfixed although they say thats an oversight and if we send it back to them they will repair it.

As a result I have emailed them and asked for a refund under the Consumer rights act as both have been sent in for a repair and both have broken again. It's within 6 months of purchase so the fault is assumed to be there at purchase which I understand gives me the right ro reject them?

They have offered to repair and if that fails again replace as they are saying I had them repaired under the warranty and not under the consumer act so now I have asked for a refund they are applying their right to repair.

My problem is I have no faith in their ability to repair them and given the problems have been intermittent and come and go i don't trust any repair to actually last and am worried if they break again in a few months I'm stuck with them so would rather just return and get the refund.

Am I able to insist on this?

Thanks

I think you are. It's been a while since I worked in retail (and I'm not a lawyer, but I've worked it customer service) and we were always told that customers could have a full refund for the first six months as (like you say) the fault is assumed to be there when you bought it. It's only after six months that the company can insist on a repair or replacement.

They have offered to repair and if that fails again replace as they are saying I had them repaired under the warranty and not under the consumer act so now I have asked for a refund they are applying their right to repair

And this sounds like flannel on their part. They're trying to fob you off. But again, I'm not a lawyer so it might be worth contacting trading standards.

Thanks. Well we currently just going round in circles with them saying they can repair it and me saying I don't want them to.

Does anyone know how / what I can do to escalate this?

Thanks
