Courier has damaged my car and ignoring contact

It has now been over 2 months and my car has still not been fixed. Story is , I ordered a parasol online from a large supermarket chain and the courier delivered it when I was at work but he had assumed I was at home since 2 cars are there but we have 3 cars. He left it at the corner of my house rang my doorbell and left within 2 seconds- all recorded on my camera. 1.5 hours later the parasol has blown it over and it lands and hits my car causing damage to the paintwork- again all recorded on camera. I contacted the supermarket and sent in the video footages. They then asked me for a car garage estimate which I sent them and it was £550 so they asked for 2 more estimates due to the cost which I got for them and it was between £900 and £1000. They have then said that the courier will be in contact with me. I have spoke to the courier who are saying that the depot guy ( delivery man) will be in touch as it will have to go under his insurance. I spoke to the delivery guy once and he started giving me a story about the courier are terrible to work for and he doesn't know anything about the damage and he will phone the company and get back to me. He said that his insurance might only cover the work van and not anything else. I spoke to the courier and they said that he should have liability insurance and she phones me back to day the depot guy will arrange a car body repair specialist for another quote ( even though I already gave them 3) It has been over 2 weeks since I've had any contact from him. I've phoned him and left some voicemails. I have also messaged the supermarket several times and it's the same message that they will get it chased up but no contact has been made with me. They even said that the depot guy said he has tried contacting me but I've not answered which is lies considering I've had no missed calls. I know the depot guy is trying to get away from paying up- but he has his own insurance

Can anyone please tell me what actions can I take? This is dragging on for too long and I am getting fed up chasing it up. Although my car is cosmetic damage , I would still like it fixed.

Don't see why it's my fault that he left the parasol at the corner of my house where it's easy to topple over instead of next to my door and away from my car. Surely an item at that size and put in an upright position is easy to fall over.

I don't think it is the courier is fault. I mean, I can see why you'd be passed off but I think it was just unfortunate.

Get a quote from one of those companies that repairs paintwork on your driveway. It's likely to be cheaper than a garage. The one I used did a great job.

Yes the supermarket sub contracted the courier and I think they were unsure themselves who is at fault.

I feel it is negligence on the delivery guy's part. I didn't leave any instructions for the parcel so it could have got stolen too. Surely common sense would tell you not to leave it beside a parked car. He could have lay it flat on the ground. The problem is that he just assumed that I was at home and I would open the door and take it in but unfortunately I wasn't.

I also don't think the courier was at fault here. I think it's just one of those unfortunate things.

I think you'll have to claim on your own insurance. Annoying I know, but that's what it's for.

@SoupDragon yes I have been unlucky and I thought should I let this go. After speaking to the courier guy ( the one and only time on the phone ) he seemed nice and genuine and he's an older guy telling me about his work and so on but I'm losing my patience that he's ignoring my calls and not giving me any update. At least have some sort of communication and don't promise to call back and make up stories.

It's kind of like if you receive goods delivered and they are damaged, of course you would want it rectified. You wouldn't go and purchase another one. In this case the parasol wasn't damaged but my car was.

@DramaAlpaca I know what you are saying but the courier also have their own insurance for any mishaps too. What if they scratched or dented a car whilst taking a parcel to a door, that would be their fault.

It's not allowing me to add a photo to show you exactly where he put it.

I'm another one that doesn't think it's the couriers fault but just an accident that unfortunately happened.

There is a big difference between them actually damaging the car themselves and something happening 90 minutes after they'd left.

I can't accept that it's 'just an accident' and I would have to fork out my excess in my insurance and lose my no claims bonus over the actions of the courier. Other reputable couriers would leave it at a back garden or a safe place. Not right in front of my house beside my car!! I don't consider that a safe place.

How can it not be the couriers fault. They literally dumped a package and left it Hmm. That is not acceptable at all and any damage has only happened because of that action.

Your contract is with the retailer who then have a contract with the courier. Go back to the retailer and tell them you are not happy with them using to shirk responsibility.

Also, I wouldn't be contacting my own insurer for something that was someone else's fault and entirely avoidable. That would cost OP money.

@premiumshoes thank you! It's unbelievable people are saying that it's just an accident. If it smashed through their window screen or put a giant dent on the bonnet are you supposed to shrug and say oh that's ok it was my fault I was at work and couldn't bring the parcel in? No you wouldn't.

I didn't want to involve my insurance as I don't want to pay any excesses but I will definitely call them and get advice. I will get the letters done and take it from there. Thanks again for the advice x

Oops sorry just re-read @premiumshoes that I've not to call my insurance, I misread. Ok thanks. I am glad some people can see my point and I am not going insane for paying for someone else's actions 😔

Let your insurance deal with it, that’s why you pay them. If you report it to your insurance they will then decide if the courier / store is at fault and arrange to seek payment from them. Honestly wouldn’t bother chasing them as it could go on forever. Let the experts sort it.

Are you seriously comparing the 2?

This courier dumped a package outside someone's house and it then caused damage to her car. The package should not have been left.

Most couriers dont leave packages outside here. If you don't answer they ask a neighbour or take it back on the van. There are literally no parcels propped up at the corner of people's houses waiting to fall.
