New build, who registers the property with Land Registry?

Hi all, our house is about 8 years old, on a large private estate, built by a countrywide well known builder. We’ve come to sell and have been advised that it’s not registered with land registry and We have had to pay to do this before we can sell. All of the houses around us are registered, including our semi detached neighbour and we just wondered why ours isn’t and who was responsible for this when it was built. Can anyone advise? Thanks

Usually it would be the conveyancer/solicitor you used to purchase the property. Who provided you with the title report, carried out searches etc? They would usually be the ones to register everything with the Land Registry.

Our solicitor did it for us. I just checked our financial statement which showed all the payments in and out and as part of the fees is the cost of land registry.

I would check your statements to see if they took the fee?

You should contact your solicitor promptly and ask them to explain. Also go on to the Land Registry website and do an index map search (it's free) which will confirm whether or not it is registered.

I presume you bought with a mortgage so I suspect it is registered.

Thanks, yes it is registered but unfortunately not in our name,the solicitor who dealt with the purchase (recommended by the builder) went out of business about 12 months after we moved in. The forms have now gone off to land registry to be expedited. We thought it was strange that when we came to get the energy certificates there wasn’t one for us but there was for all of the neighbours and now this! We’re also waiting for a deed of variation from the builders who are not very forthcoming and we’re being passed around, between the builder and management company it’s a nightmare! Stupidly the house we’re buying is on the same estate and we’re too committed to get out now without losing so much money 😕

Who’s name is it registered in?! That’s massively incompetent by someone. Was it a solicitor or a conveyancer? There may be something you can do if they were a member of a regulatory body and if they’ve properly gone out of business or been taken over by someone else. Doubt you’re going to be able to sell until the issue is rectified which may take weeks at the moment. Does your purchaser/vendor know? Start gathering as much information about what has happened...good luck!

Took me nearly 2 years to get the title deeds to my new build. Develop solicitor was the problem

Thanks, The property showed as built but we believe it’s was still in the developers name, we’ve actually just had some good news after speaking to land registry first thing yesterday and it’s gone though and our solicitor has sent the documents to our purchasers today. The original solicitor was not linked to the builder but was recommended as one they worked with so I’m not sure there will be any comeback. Now we just need the builder to provide the deed of variation which is proving very complicated and a long drawn out process as nobody seems to want to accept responsibility. I can’t fault the land registry though, it may have been coincidence that we spoke to them and it’s gone through but we’re one step closer! If anyone has a contact for the legal team of a large building company based in Hemel Hempstead then it would be appreciated Smile
