My sister has asked me for advice but I don't know what the legal position is, so I thought I would turn to the wise ladies of mumsnet. In approximately 2000 she had a CCJ against her from the student loans company. She shouldn't have been repaying the loan as she was on long term sick due to serious mental health issues, but there was mix up with the deferment paperwork. The CCJ was never enforced and has now vanished from her credit history. Could the CCJ be enforced now, after 20 years?

CCJs are unenforceable after 6 years, but any enforcement action they may have taken in that time (such as charging order) would still stand.

There are various companies who buy unenforceable debt and then try to pursue recovery, threatening "action" (whatever that means) in order to mislead people into paying such debt. Student loans are a particular target.
