Baby's father not named on birth certificate wants to take me to court for parental rights. How long after he instructs his solicitor do we get a court date? What is the process after he instructs his solicitor to take me to court ?
In Scotland.
Many thanks.

Are you fighting for him not to have it and if so what are the reasons?

Dogssox · 12/08/2020 18:45

I'm not fighting him as such but I want him to take anger management before I agree to it. I was supposed to be in negotiation with his solicitor but apparently he just wants to go straight to court. Which says to me he doesn't give a crap about anger management and is quite happy to subject an innocent baby to his foul temper.

So he's abusive then? If I was you I'd say that you don't want him to have PR otherwise you get no say on what happens when he's with DC. He could go for 50:50 or full custody even. Do you want a man with w foul temper to have 50/50 say in your child's life? Obviously court can decide to give it to him anyway, but there are more likely to give conditions if you fight that he (as he is right now) would not benefit your child.

PR and contact are two very separate issues. The awarding of one doesn't mean the awarding of the other. He will get PR regardless of attending any courses. Contact is different though. Don't confuse the two issues.

Titchy is right. You may be able to insist on an anger management course before contact, but it is unlikely to be relevant for PR (which is parental responsibility, not parental rights).

Thanks for replies. I have a meeting with a solicitor next week.
