I took my brothers will in the bank and they said it wasnt valid. It was signed witnessed and dated .anyone got any idea why it was refused

No. Probate is not compulsory. It depends on what is in the estate.

If the OP's brother owned land, property or shares in his sole name probate would be essential. If he did not it depends on the bank and any other asset holders. If they are willing to allow the OP to access her brother's assets without probate, there will be no need for the OP to apply for probate.

It wasn't NatWest was it? I found them to be shockingly bad when I was in a similar position.

At TSB the threshold is £25000 befor you need to apply for probate ,he had no property and less then the required amount needed to apply
