Mortgage with Child maintenance, help/advice

Question below.

I have separated from my ex partner, we have a joint mortgage on our house.
Our son will be living with me full time.
As I gave up work when I had our son I have been looking to move out with help from housing allowance and UC, with this I can only afford a 1 bed flat in our area.
My solicitor has asked if I calculate the cost of remaining in the house as this may work out the same price then we can stay in a 3 bed house and my ex move out.
I have been trying to do this however I do not fully understand and cannot seem to get through to any helplines.

My question is has anyone done this that can advise? Will the mortgage be split between the two of us or will I have to pay the entire amount or will he still have to pay the entire amount.
Also will we still be entitled to child maintenance if we remain in the house, and if so is this on top of him paying the full or half mortgage or instead of.

And/or any helplines who can help.
UC and the council have not been too helpful.

TIA

You have two options, if you are not married.

One is to buy out his share of the equity which is presumably 50%. To do this you extend the mortgage by this amount and then take over the mortgage. This is a clean break.

Alternatively, you could try to get an order to allow you to stay in the home paying the mortgage whilst he retains his share until it is sold. The order would last for a period of time. Probably not until the child is 18. It might not be affordable for you or him. He needs a home and you don’t need a 3 bed house. This would be factored in.

As you are not married he only has to pay child support to you. Unless he is incredibly rich.
