hi on 6th june 2020 at 1155am i was stopped by police he said i had no insurance on my car i said i had he said show me i said it is at my home
i asked him the bobby to phone my insurer the co-op he just grunted and said we are taking this car to pound,, my wife and i had to make our own way home with load of shopping i am 78 years old he gave me bit of paper and they were taking my car to charlton police pound miles away,we got home checked my ins and phoned the co op who also verified my insurance was in order,i had ins from nov 2019 to sept 2020 ,, i phone 101 police and a pc [redacted] told me that a certificate was only a bit of paper he refused to speak to the co-op person on the other line saying data protection did not allow he told me to go to the pound and let them sort it out as he was busy,, went to pound waited there for 2 hrs then lady there said my insurance was not on thier data base come back on mon i had to beg her to ring the co-op and at 5.45 pm she rang them when they verified my insurance
but i had to pay £150 before she would let me take my car , then i got a fixed penalty notice to pay £300 and 6 points on my clean licence this was dated 7th june 2020 the only way i could answer this was by post which i have done and enclosed cert of ins and idemnity letter from the co-op to also state that i had full insurance it is now the 16th june and the plods have not replied to me but if they dont drop this case i will see them in court,, my insurers could not be more helpful

It sounds like coop hadn't put your details on the MIB Database? I'd ask them outright.

Not sure you should have named the police officer. I've reported your post to MN so that they can consider and remove the name if necessary. They will leave the rest of your post intact.

You clearly have not committed an offence so the fixed penalty notice should be rescinded. Unfortunately, if Co-op failed to update MID the police will not refund the £150 you had to pay to recover your car. However, if that is the situation you may be able to claim the £150 from Co-op on the basis that they have clearly breached Article 76 of the MIB Articles of Association.

the un named policeman gave me his name i did not ask him for it and he did not tell me not to use it,,and he did not give me his no, and i did not ask him for it the constable who stopped me and reported that i had comitted an offence had to write his no on the paper he gave me with address of police pound,,he was an agressive little man and kept pointing his camera at me my irish accent seemed to upset him and he said keep back i was wearing a mask and i told him he should be wearing a mask he said the police dont have to wear masks i did not know that police were immune to covid,, they can get it too old boris got it and he stopped shaking hands since,,,as i said my insurance company could not be more helpful and will pay for my police pound bill,,what really makes me mad about this was the attitude of the police
as i had insurance all along and all the plod who stopped me had to do was make a phone call to my ins ,, he had plenty of time as they had to wait for the tow lorry to come,,,to pick up my car,,and the other one on the phone who would not talk to my insurers muttering about data protection when the co- op person told me that they talk to the police every day to verify insurances,, why cant they speak the truth,, and the lady in the police pound she waited till the last minute to ring the co-op hoping they would be closed and that i would have to go back mon morning,,and to add salt to the wound they sent me this penalty notice for an offence i did not commit,,as i said im 78 years old and as far as im concerned the police are a bunch of bullies

From your post I can see that your still upset about this and quite often than not dealing with police ultimately comes down to attitude test, coming from Irish blood and having to get my own grandfather out of quite a few pickles with the police including being caught speeding twice in the same day I’ll offer you some advice.

Usually you can check yourself on the a website if you google check if car is insured. Ask MID I think.

However it seems a little strange from such a time frame for the PNC not to be updated properly, follwokg we this does happen and sometimes PNC is out of date usually in the case of renewal it can take a few days to update which was the case for me when mine renewed I was stopped the following day.

A certificate is issued and a direct debit can be cancelled so is not always what is proof because people do pay for insurance, get documents and cancel, however the unwillingness to co-operate and ring and find out is not very fair at all, I showed the officer on my phone but he still called and checked, this a quick process for police.

My suggestion would be to contact the police station by phone or in person with your documents, ask to speak to the duty inspector and explain what happened calmly, refrain from using phrases such as plod etc, ask them to call your insurance there and then to confirm this.

If you still feel this is not being resolved you’re within your rights to make an official complaint from the IPCC and have them look at it for you

Why were you shopping when you should be shielding? Shock isn't there someone who can help you with that?

i thank everybody for replies just to pick out a couple of remarks which were made as i have lived in the u/k for 61 years i have never had any
trouble with the police before as i said i have a clean licence and never had any points on my licence , i have never even had a speeding ticket so i was in complete shock when the beard said that i had no insurance on my car,, and yes i am afraid i was 78 years old last march, but am very fit after worked at roofing all my life but now retired, yes you wise old person i should have been shielding you are correct in that ,, but i dont consider myself 78 as i am fitter than alot of 60 yr olds,, i dont smoke or drink never did but i still enjoy sex only with my wife,,,i now know all about checking my car insurance on my desktop but only because this has happened to me i pay 12 months ins put my papers in the safe and forget about them until i get reminder to renew,,my insurer made a mistake not putting it on the data base and put thier hands up to this right away i have no complaints about the co-op i have no problem with anybody except the police attitude as i said they are a bunch of bullies,, and mister
i dont want anybody to get me out of scrapes as i dont tend to get into any,, i mean i have heard stories about the police that would make the hair stand on your head and they were all true , these things did not happen to me so i will not repeat them, only what happened to me
and i thought things had changed but im afraid ref police they dont change

How about you just say I was stopped by the police, I wasn't showing as having any insurance so they impounded my vehicle.

I was able to prove I have insurance and so everything is fine now.

You won't get points as you were able to prove you had insurance.

You will have to pay for the car removal as they are an independent company...

If it's your insurance companies fault that your policy didn't show up on the police database, I'm sure you can claim costs back from them.

in answer to what did you want,, well my friend what i wanted was to be treated like a human not to be grunted at like a dog and while we are at it how would i know,,, i dont go around with my head in the sand i could give you 15 examples of what happened to mates of mine over the years at the hands of the police but as i already said these things did not happen to me so i wont repeat them here ,,,and in reply to police slate yes of coarse it may seem like that to you,, but i am a law abiding person and did not expect this the only people that done me wrong were the police ,, i have already sorted everything out with my insurer and they could not be nicer about this matter

The policeman may have given you his name freely but that does not give you the right to post it on here. That is potentially a GDPR problem for Mumsnet which is why they have now removed the name from your post.

Since you posted in legal issues it is natural for people to assume you wanted legal advice.

The police don't have to wear face coverings. Indeed, no-one has to unless they are using public transport.

In normal times the police would have rung the MIB Police Helpline who would have rung your insurers and confirmed that you had insurance. However, the helpline is not currently operating at weekends due to the pandemic.

Why should they be shielding? The only people who should be shielding are those with specific conditions who are classed as extremely clinically vulnerable. Age has nothing do with shielding.
