Self Employed and being my PA (carer)

I just wrote a long post and lost it...grr!

My husband is self employed in a job that requires him to be in other peoples bathrooms/toilets/kitchens. Technically the Govt. say he can work, but I have MS and am a wheelchair user. My condition has severely deteriorated since lockdown and I need him to lift me between chairs/sofa, toilet, bed, help me dress/undress and to make lunch. We are shielding too.

I usually employ a PA but she obviously isn't coming in as that would unnecessarily expose me. She also happens to be off sick (has been since Feb), and gets SSP.

Shielding in Wales (where we are), has been extended until the 16th Aug. Back at the end of March I asked Social Services if he could be employed as my PA (carer), and they agreed (and didn't ask any questions or want any further info). I've since contacted them asking if he could be extended until 16 Aug. They have come back asking if he is furloughed or has received a Govt. grant. I haven't responded yet because I want to check things out legally.

At the end of May he received the Govt. grant of 80% of his wages for 3 months, this was obviously taxed. The income he received as my carer (17.5 hours a week), is also taxed.

So, after all that I'd be grateful for any replies on where he stands legally please?

I think it might be to do with getting two lots of public funding- you'd have to ask them for a proper explanation though. But public bodies were not allowed to use the furlough scheme to cover the wages of jobs already paid for by a govt subsidy as it would be two lots of govt funding.

Is your PA (whoever it is) paid for (in part or in full) by direct payments rather than from your own income, whatever your income is?

Who is paying your regular PA's SSP?

My PA is paid by direct payments which I also contribute to. I've looked it up and am aware you can't work and be furloughed, but I can't find anything anywhere that states being self employed, receiving a grant and working.

My PA's SSP is paid by direct payments which is then claimed back from social security as far as I'm aware.

Just got an email from SS saying

'I have been able to answer one of the points raised by panel yesterday concerning the status of your existing PA. namely that they have been off sick.

Consequently I made further representation to the panel members this morning and thankfully they have endorsed your request for DH to be your formal PA for 21 hrs a week up to the 16 August'
