Family solicitors, I'm a being stupid?

I have been told I need a family solicitor to help with the legal matter of our property since separating from my ex.
I do not work as I am caring for my 2 year old full time I have been advised that I can get a solicitor free of charge.
However no one has told me where to find one?! I have emailed a couple of solicitors who have said thay they will take my payment out of what I get off of the house which will barely cover it.
Am I being stupid or is what I've been told not a thing and I do have to pay.

TIA

You should look at legal aid.

Unravellingslowly · 13/05/2020 12:52

Who advised you can get one free of charge? Are they thinking of legal aid? Some info here.

Some people are entitled to legal aid but it’s being cut and if there’s a house with equity, chances are you might have to pay for your solicitor.

There is a link to legal aid above which will help. A solicitor with a legal aid contract would fill in the application forms for aid at your first meeting generally.

Im assuming you prob don’t qualify if you’ve spoken to solicitors with legal aid contracts already and they’ve said there’s a charge.

@Unravellingslowly
I was told in an email by my ex's solicitor, but the only options there are on legal aid are if you are living in a domestic abuse household

I doubt you will qualify due to the government cuts to legal aid

ChampagneCommunist · 13/05/2020 13:37

Why would you not have to pay? I don't know of any property lawyers (and I am one) who do legal aid work- I don't think it exists for property work.

You might be entitled to it for family law work if you qualify (if he's abusive).

Otherwise, you'll have to pay. Who told you you could get work done for free?

DownToTheSeaAgain · 13/05/2020 13:51

Legal aid isn't available for property work.

A1992M · 13/05/2020 14:25

@ChampagneCommunist
I was told in an email from my exs solicitor that I would need to get a 'family solicitor, this would be free of cost to me'

I assumed it was because I am not working after giving up my job to raise my son.
I've never had to have a solicitor before so not sure how anything works

Do they mean that your ex would pay for it?

GreyishDays · 13/05/2020 14:27

Can you email them back and ask what they mean?

purplecorkheart · 13/05/2020 14:31

I suspect your ex's Solicitor means that the money from their fees will come from the property sale rather than you actually having to hand over money to them.

GreyishDays · 13/05/2020 14:38

What do they need to do? Just handle the sale? Or is there anything more.
How much did they quote? (The ones you asked.)

A1992M · 13/05/2020 15:16

@getdownonit I highly doubt that! Hmm

@purplecorkheart it's not being sold, hes keeping the property just removing me from the mortgage

@GreyishDays just looking over the paperwork I suppose. The house isnt being sold, he's just removing me from the mortgage 🤔

I've managed to find a solicitor who understands what the email said and is going to help me.

Thank you all for your replies
