Hi all .Iam having a similar problem .My neighbour is in the middle of erecting a summer house , It is 2.8m high and about 2ft away from the boundry which is a 6ft fence It has been built on a raised patio .It is imposing and is going to be even higher when he adds tiles to the apex roof , Does anyone know if he is breaking the rules He says he does not need planning permision !

The majority of summerhouses and garden rooms do not require planning permission. However, permission is required for any summerhouse which covers over half the garden, which is not for domestic use or which is over 3 metres high with a pent roof or 4 metres high with an apex roof.

My understanding is that height is measured from the ordinary lie of the land. So if it sits on a raised patio the height will be taken from the land under the patio.

The raves can’t be more than 2.5m so doh dd likes he’s breaching this. Take photos and contact your planning office.

Hi everyone thanks so much for all of your advice I have taken photos and informed the planning office who have sent the photos to their chief planning officer my neighbour says that because it his boundary fence which we went halves with says he can have the structure as close as he wants it is huge standing 2.5 without taking in account of the roof and is at one end only about 15 inches from the fence he says he it can be 2.5to the eaves and if it is a bit bigger by a few inches it will be passed by the planning office any further advice would be most welcome stay safe out there x

You don't need any futher advice. There is nothing more to the planning regs as you have been told on this thread. Keep your fingers crossed the LPA decide to do something about it. They have a power to act, but not an obligation.

Might be worth talking to your local Planning Enforcement Officer. Planning Officers deal with applications, sometimes the Enforcement Officers get left out of the loop...

You may want to do a bit of research on Permitted Development, which specifies what construction is exempt from Planning Permission (this is what your neighbor seems to be relying on). His logic is rubbish, but he may be be exempt under PD regulations, I’m afraid I’m a bit out of touch on current regulations on this.
