Finally found the courage to leave my controlling H last year. It's been a real struggle for many reasons, including financially. I've now got my Decree Nisi and our family home has finally sold. (But not yet completed due to delays because of Corona)

H hasn't paid a penny for maintenance/joint liabilities and is claiming benefits (although working cash in hand) I've applied to the CSA and really, chosen to 'let it go'. However, when the house sells there will be a lump sum of equity to divide up. We've tried mediation and got nowhere - he wants 70% and not pay anything for our son. So I need to apply to court. Can't afford a solicitor. Have got Form A but am really struggling with it. Do I just need to apply for a 'lump sum order'? Do I need to put down property details if I'm not applying for a 'property adjustment order'?
It all feels so difficult at the moment. I don't even know where I'm going to get the form copied during lockdown!

Download the form A from the court service website. Make sure you get a MIAM (mediation related) or are exempt. And accept that when the house sale completes you'll each be able to walk away with your halves unless either of you instructs the conveyancers that there is a dispute and they are to hold on to the proceeds pending agreement/court order.

On the maintenance even if he is on benefits he will need to pay so maintenance - yes only £7 per week. I was in the same situation and it is a principal to me that he pays towards his child. So I would not let it go, if he doesn't comply the can deduct at source and pay you.

On the question of which orders you are applying for, if you aren't sure, tick the box. That keeps your options open.

Have got copies of the Form - the Miam bit filled in by the mediators is hand written and I've only got the one copy - do you think they'll accept a photo in lieu of a photocopy?

I feel the same about the maintenance - he's been on 4 holidays abroad since we split, and bought himself a brand new van (traded in the family car, don't suppose I'll see my share of that at any point). I'd be happy to split 50/50 but he wants the lion's share, even though I earned more than him for our entire marriage.

Can I email the completed forms to the court?

The courts are encouraging forms to be emailed in - you'll have to ring in too and pay the fee, so put your phone number on the email and tell them to call you to take payment.

You just take out the blank page from the Form E and replace it with the page the mediator filled in.

Hi I am looking to do my Form A and would like any advice as i have spend ten thousand on Solicitor and no further forward. I want to do this myself and not a Solicitor. Has anyone else done this?
