Hello
Abusive ex and I have a child arrangements order. DC live with me during school term, but have EOW and half the holidays plus Weds tea time with Ex informally. Ex has been in touch to say now schools are closed it is like holiday so DC should be with him 50/50. Has said he has taken legal advice and if I don't comply it will get unpleasant.

Pls can anyone advise?

Thank you

This is NOT a holiday. Children all have work set, some are having online lessons etc. Not meaning to be so personal but bluntly would your children no count as vulnerable and thus be allowed to keep attending?
(Though am I right, and at least two have serious long term health issues such as diabetes? Forgive me if I've got the wrong poster)

Thanks for replying. Children do not count as vulnerable. Abuse was only of me, not DC (as I protected them).

Do your children want to see him more?

Why don’t you want them to spend more time together?

PaulinePetrovaPosey · 19/03/2020 17:46

Loch...did you not read the word 'abusive'?

Quartz2208 · 19/03/2020 17:49

Yes schools may be closed by online learning will take place so the holidays are still the holidays

Tell him if he has received legal advice to send a letter via that and you will respond to that

www.nidirect.gov.uk/articles/school-terms-and-school-closures#:~:text=When%20a%20school%20must%20close,count%20as%20a%20school%20holiday.

Send him this is clearly states:

When a school must close unexpectedly, the closure doesn’t count as a school holiday.

LochJessMonster · 19/03/2020 18:22

@PaulinePetrovaPosey yes but to her not the children. He’s obviously competent and safe enough to have a fair amount of contact anyway.

So what’s the argument for him not having a bit more time now?

HappyHedgehog247 · 19/03/2020 18:34

Hi Loch

No the Children do not want to spend more time with him.

This is not a formal school holiday.
He is more than welcome to escalate this matter to court....

Also I would say that as he has sought legal advice you will be happy to communicate through his solicitor from now on.

prh47bridge · 19/03/2020 19:40

I doubt he has taken legal advice. As others have said, whilst schools will be closed it is still term time. The school attended by my youngest will be delivering the normal lessons at the normal times via the internet. I imagine many other schools will make similar arrangements.

Tell him you are sticking to the court order.

Thank you so much. Feeling a bit stronger already.
