I have posted about this before, but OH had given me the wrong info (he is really useless at this kind off stuff ) and so I am now posting again with the correct info as the advice has probably changed.

OH and ex separated 7 years ago. After two years, his ex applied for a divorce (originally he thought he had), they got the Nisi but she never ended up applying for the absolute. Neither really realised and both carried on as if they were divorced.

OH and I are (supposed to be) getting married later this year, nothing booked yet. We went to get our paperwork together to give our notice and he realised he didn't have the absolute. He got in touch with his solicitor who got some paperwork together and sent it out to his ex along with a clean break order.

Things between them are far from amicable and it looks like she's refusing to sign this paperwork for both the absolute and the clean break.

OH is going through a difficult time and is finding it hard to keep up with what the solicitor is telling him/remembering what he says. This is upsetting me as I feel out of the loop with where I stand in terms of our wedding but anyway that's an aside.

How difficult will it be to get a divorce now his ex is refusing to sign? If we have to go to court for this are we able to claim costs and what is the lookliehood of receiving those?

He's almost certain to get the absolute, and probably costs too, given she's done nothing in 7 years. Should issue urgently though. May already be too late. I reckon courts are about to go telephone hearings only very soon. In normal circumstances you'd get a hearing date in 3 months. Don't book your wedding until the DA is in.
