My mum has had a business in the same shop location for 23 years.
She originally had a 10 yr tenancy. When this ended the landlord didn't respond to repeated requests to formalise a new tenancy. The landlord was ill and not interested in taking on more stress.
Therefore, the agreement was assumed to be a rolling contract, she has continued paying rent.
Last year the freeholder/landlord died.
The freehold is for 2 leasehold flats and the shop.
Her son visited and advised he wasn't going to sell. However, valuations for probate went ahead, and he changed his mind. Verbally stated mum could buy it. He lives is the US, this is uk based, he consequently did not respond to e-mails/ communication asking if my mum could buy the freehold, and how to proceed.
Now the freehold has been put up for sale, mum made a full asking price offer to the agent, had no response from the agent. The agent then asked my mum to carry out viewings, which she has refused to do.
As there appears to be no communication regarding her offer, mum asked her solicitor to contact the agent. At which point they advised a cash offer had been accepted. This buyer hasn't viewed, mum got no response, and can also be a cash buyer.
We're not sure if her rights have been breached.
Can anyone advise or point us in the right direction?
