What would be the likely outcome IF my child's father went to court ( I don't think he will though ). Basically the back ground is ive been a single mum since the day my daughter was born and throughout pregnancy. DD is nearly 2 now. Currently he lives 45 mins away from us yet he's only bothered to see DD on a visit maybe an hour every 2/3 weeks and constantly makes excuses. He has never had her overnight or ever had her alone ( reasons behind this like he has shown anger towards her in the past ). He is like a stranger to her ( not nice to say but true ). I've tried my hardest to get him to be more involved but he isn't interested and doesn't seem to be changing his attitude and temperament. She doesn't see his family either . ( their choice ). I'm thinking of moving 4 hours away back to where my family is. This is 100% better for my daughter than being stuck here with no family waiting to see if he can be bothered with her or not or him shouting at her for crying etc . If he went to court ( it would purely be for control purposes or it would kick him up the ass ) what contact would he likely be given in these circumstances?. He drives. I haven't stopped contact as I'm worried about it going to court and him getting unsupervised contact but think I it inevitably will happen if I move, just hoping the courts all this into account. Thanks in advance for any advice given.

He would be wasting his time but that doesn't stop controlling exes trying. It doesn't sound like he would spend money on a solicitor though

In your situation I would just move and tell him after. There’s no reason why you can’t relocate to be closer to family if it provides you with extra support and family connection for your DD. He could use a prohibited steps order to stop you moving but I doubt he’d bother, not sure whether a PSO can be used AFTER you’ve moved iyswim. But worth checking. As long as you aren’t taking DD out of the country and moving is in her best interests I don’t see the problem.

Just star doing a slow fade and move. Tell him nothing. I wouldn't even tell him where you live. Can't send a solicitors letter if he doesn't know your address can he?

annablack · 06/03/2020 11:10

Wouldn't a solicitor be able to find out my address though?. I don't think he would bother. But if he did.

@annablack maybe. It will cost him more though. I'd just do what you want. He doesn't sound very interested

annablack · 06/03/2020 13:59

He definitely wont be keen when he finds out the costs

Is he on the birth certificate? Does he have PR?

annablack · 08/03/2020 21:13

@opticaldelusion no he isn't on the BC and doesn't have parental responsibility

Unsupervised contact is way down the line, if ever. Just move. If he wants to see your DD he'll have to take the court route, applying first for PR. And pay for it all. Sound likely?
