DBS Check (Scouts Association)

Can anyone answer a question for me or know how I can find out the answer (i.e a solicitor or suitable person to answer)?

Applicant has a caution from 2015 for drunk in charge of a minor (child under the age of 7).

If they go through the application for DBS check with the scout association, will they pass?

A DBS check is just a report.

Whether the Scout Association will be satisfied with that person's history is a separate question.

I'd be surprised if they were happy with this if that person were to have responsibility for children through the Scouts. It's an unusual charge, rarely used by the police (I served 10yrs, saw it used once).

It would be an enhanced DBS . I have seen in the past certificates with additional information from the chief constable with information that they hold that may be relevant. This has included people being picked up on a section 136 for concerns over their mental health within last 10 years. If they deem it relevant to the position they can put it. You can't really predict whether they will disclose it or not.

Have also seen arrested but not charged for offences on the additional information.

As above, the DBS check is just a report. It’s up to the organisation what they do with it. But as mentioned 2015 is only 5 years ago and without knowing the full circumstances I’d be uncomfortable with someone convicted of that offence looking after young children.

They must have been in a public place and very obviously inebriated for it to have come to the attention of the police, then charged and convicted?

As mentioned it is a report and up to the scout association to decide. That decision will be based in part on the role. To become a leader probably not. If they want to be a parent helper in a camp then probably yes it will 'pass'

They could try telling the scouts about it up-front. At least that way they’re being honest.

Thank you. It's not for me but an applicant has confidentially disclosed this to me before they become a parent helper.

Really appreciate the advice you have given. It's very helpful.
