Speeding letter from police

Hi all was looking for some help...

I was pulled over for going above the speed limits earlier this week but I received the letter today offering me a fine and 3 points however, the car they have said I was driving is in fact my old car from 2 years ago that I have not driven for over 2 years and is no longer registered to me (complete different number plate and complete different car to my current vehicle)

My question is will this stand up if I take it to court saying I wasn't driving this vehicle as I actually wasn't, however I was speeding in my current car with a complete different number plate to what they have stated on the letter (the police have somehow made an error and put me down as driving my old vehicle that I sold over 2 years ago)...

I'm confused as to what to do now, do I just notify the police that they have said I was driving the wrong car or so I chance it and take it to court as they are the ones who have made the error?

If you were David Beckham you know what you would do! I would take legal advice because I thought there had to be accuracy.m in these matters. But......

If you were pulled over they might well have been wearing body cameras. So saying it wasn't you might lead to charges of perjury on top of your speeding fine.

If they are charging you with driving car X at 100 mph when you no longer own car X and haven’t driven it for years, then their charge is wrong and should get thrown out. I would write to the court making a statement to that effect. You have to point it out anyway because they could subsequently charge you with not being insured for that car.
Don’t make any statement about what car you were driving or at what speed.

They may then issue a new penalty notice with the correct details if they have the evidence but that’s up to them.

Mint is correct in that the penalty notice is incorrect so you can challenge it, but yes, you must not state anything that is incorrect such as you were not driving as that is attempting to pervert the course of justice....potential imprisonment.

If you challenge, they may drop it but also be aware they may correct it but then deal with it at court and you could end up paying a higher fine based in income

Something very similar happened to me. The police officer's statement had the wrong car model, colour and registration number. The statement was also dated about a year before the alleged offence took place! I took legal advice and the lawyer wrote pointing all of this out expecting the matter to be dropped. The officer corrected his statement and added that there was nothing wrong with his eyesight!

In hindsight, It was me, I got caught and paid the fine.

Have you updated your V5 since you sold your old car? Ie is it definitely legally not registered to you?

Yes vehicle is Not registered to me anymore and hasn't been for 2 years and yes it's defiantly the same incident in question as I was stopped on Monday 27th January and the letter states the road, time and date I was stopped which is correct it's just the vehicle registration and model of the car that is incorrect on the letter

Get over to Peppio Forums
They are brilliant with anything speeding / motor offence related . They will give you very good advice
If it’s a notice if intended prosecution know as a NIP you have then you only have 28 days to respond .
If you don’t respond then you could end up with a single justice procedure notice with a charge of failing to identify the driver which is actually a much higher fine and 6 points on your licence and a MS90 on your driving licence which will make your insurance double and more
And they can still give you the 3 points so you could easily end up with 9 points

Something similar happen to me. A speeding ticked written out for a different street.

I took my licence and insurance into a local police station. When they got to the moment for me to speak I said I didn't want to waste their time and agreed that I had been speeding and deserved the fine ... but that I couldn't in good conscience admit to speeding in when two officers were witness to the fact that I was speeding in at the time.

Got a letter asking me for a map to show the two different roads were not actually the name road with two names. I send them a sketch back and received a letter saying that no further action would be taken in the matter.

While I agree that we should pay fines, it is also rather important that the police get their facts correct. We do rather rely on them for that.

if the police gets their facts wrong re a simple thing what else are they getting wrong; accuracy is really important for a doctor or dentist getting the wrong patient not vehicle would be unforgiveable

what about if they got the wrong reg number for a wanted terrorist and had shot the car when actually someone else was driving and the alleged terrorist had sold the car 2 ago and an innocent person was killed because of out of date information

you should maybe write back saying I was not driving car reg XX52 yyy on silly street on 27.1.2020 as I sold this car 2 years ago and sent of V5 there is no need to incriminate yourself by providing further information

I got caught speeding (a fair cop) and when they sent the letter to me the envelope was addressed to me but the letters inside were for someone else entirely, and entirely different offences. I called to ask what to do, assuming I’d have to return this mans confidential information but they just said throw it out and they’d send me the correct one. It never arrived and I called them when it came time to renew my insurance to see what the points situation was and they had no idea what I was talking about. I’m not saying they will definitely let it go but they will want to know about the mistake.

Be honest with them. Last year DP was caught speeding but on the letter they had put down the wrong road. DP showed proof that he wasn't on that road at the time and it was dropped.

Let them know that you were not driving that car.

Depends if you fancy a perjury conviction or not.
Its not perjury to say 'I was not driving XX make car with reg XX on XX date'.

I would consult a driving offence lawyer as they may well say go to court and it will be thrown out.

Wonders how much a lawyer/solicit is going to cost....?
Will it cost more than the fine?
Wouldn’t it be simpler to point out the mistakes the police have made to the police & see what happens?
