Help with clean break order

Tammygirl73 · 29/01/2020 20:35

Nearly divorced mum of 2 needing to submit a clean break order to prevent a lying cheating ex from taking my future accident claim compensation following hit an run leaving me unable to work and with life-changing injuries.

Desperately trying to finalise divorce with as little cost incurred as possible.
Decree nisi has been granted and I can go ahead with decree absolute. But I can't afford to pay a solicitor to draft a clean break order, as since the accident I've been unable to work and am only in recipe of benefits

Has anyone any experience of a clean break order and can help me with wording, please? I'm told I can prepare this myself but don't know what to write!!

I'd be so grateful of any help.

TIA

Following in a similar position isnt it a financial order we need to apply for? From what I can see it details what you have now and states you can claim off each other in the future

Are you getting anything from him - equity, pension etc?

This really isn't something you can do by asking on a message board.

Google Financial Remedy Omnibus. If, after reading the specimen orders, you know what to do, go ahead and draft it. If, as I suspect, you realise there's more to it than you think, try and get one done by a solicitor for a fixed fee. Where I work we do them for £866 (a simple one) fixed fee. Use that as a guide.

Yes, I'm kind of unemployed at the moment and a simple clean break is all I need I dont have a spare £866 that's over two months rent

Thanks for all the advice. I'm also unable to pay over £800 for the services of a solicitor. Just after we separated three years ago, I was involved in a hit and run whilst cycling to work! I now have life-changing injuries and am still need more surgery and I'm only in receipt of disability benefits. It's a straight forward clean break ( no property or assets) I just need to cover myself so that when I get my compensation for my injuries and loss of earnings he can't get his greedy hands on any of it!
I think I can make sense of the paperwork but it would be helpful if someone could share a draft of a completed clean break order.
Once again thanks to everyone for their advice

I’m not legally qualified but I’m wondering if a DIY type of ‘order’ would be enough to protect you

Don't apply for absolute until finances are sorted.
