Can some help me with an electricity drama!

I do have a thread on this and will try to link but -

  • moved into a shared flat with 2 other people in June 2018, flat is above a letting agents and electricity is a shared supply so the deal is we split bills 50/50
  • December 2018 I take over paying the bills for our flat and in January am told how much we owe by the letting agent, paid all fine
  • in 2019 I constantly ask for bills and the letting agent assures me she’ll sort out who owes what and tell me, this never happens
  • in September 2019 they move out and tell me we owe £700. She sends me about 5 bills and it appears through the year they’ve been paying random bits of money so it’s now difficult to work out what we owe. I also feel uncomfortable sending money to her directly as there appears to be odd things going on with the business
  • I contact EDF to ask how much is owed, how I can pay and how I can get our supply split so we have our own account. They refuse to help as the account is not in my name
  • downstairs has been empty until last week when a new business took it over
  • first day they moved in EDF came round with bailiffs demanding £1,600 and threatening to turn off the electricity
  • new tenant persuaded them it’s not their debt and instead they installed a prepay meter
  • new tenant has told them to go after letting agent for the debt and is working with us to split the supply although is having same problems getting through to EDF as it’s not their name on the account

My question is can they go after us for this money? I’m more than happy to pay what we owe and am very concerned this is now a large sum although EDF have proof I’ve been trying to sort it out since last September. I guess they will now go after the letting agent as the account is in their name but can they in turn come after us?
There’s nothing in our contract to say we split bills 50/50 and it’s literally only electricity, everything else is our own

This is definitely what we plan to do but my concern is the historic debt from the last year with EDF. Are the estate agents able to come after us for it?

They can only claim for one year, so cannot go back further. What type of tenancy was it and did you all have seperate individual tenancy agreements or was it one tenancy agreement you had jointly?

It’s one tenancy agreement we have with the letting agents. However they also were renting from our landlord and fell out with him and so no longer manage our flat so I have no idea if it even stands anymore

So you had one tenancy agreement for the three people. Two gave notice but you remained in the property? What date did the others move out?

Do you know what date the agents gave up management of the flat? And on the original agreement were the agents named as the landlord?
