So firstly I know I can just ask my neighbours, but we don't particularly get on well, as a few summers ago they were throwing over cat poo, over the fence, on to my children's summer house! Wasn't even from my cat so obviously my husband (rightly so) got very angry, hence why we don't really talk.

So when I look out my back door, the fence to my left... is it mine or the neighbours? The winds making one of the posts very loose and I'm worried it's going to fall.
The house is only 7 years old and we are the first to own it. The developers never told us (they were as useful as a chocolate teapot). I'll be making a call to them but I'd just like to hear what is your view as I know some people say the left side is yours?
When the neighbours and I confront id also like some poo to hit them with too Crown Wink

Are you sure the TP1 that you signed when you bought the house doesn't have any T marks on the plan?

Your deeds should indicate who is responsible for/who owns the boundary. You will have got a copy in your legal documents you had to sign for the purchase. Unless it specifically states that you or your neighbour are the owner of the boundary, then it’s likely to be shared responsibility.

It's not always the left side. Is the 'ugly' side of the fence facing you? That usually means that it's your fence. However, it wasn't clear in my deeds and neither neighbor knew either and both refused to pay when the brick walls separating our gardens were at risk of falling down. I said I would pay to replace it with fencing (the risk was highest for me as I had young kids and pets but neither neighbor did) if they were ok with that and did - with the ugly side facing out.
If it's a relatively new estate it must be written somewhere on the deeds but ask around what people have done.

There's nothing on the paperwork! The only thing close to it is where there is a map and our plot is marked out with a red pen.
We have the nice side of the fence, but as we are the end terrace of 4, the other fence around our terraces are all pretty side facing out anyway so I'm not sure if that helps.. but our home was built by Bellway who are absolute cow boys.

I think I'll have to call someone who has more detailed paperwork on this aren't i. I remember there was an option to pay for a higher fence when we bought the house but we never heard anymore of it as the added extras we had paid for didn't get put in!

I've told my partner maybe this is a good chance to rip it out and put a new, stronger higher one in..

If not designated it is probably shared. Who put up the fence? Whose Land is it on?

As pp have said it will be shown on the plan attached to your TP1 (not your title plan itself).

What about in the content of your TP1? I can’t believe a 7 year old property doesn’t detail that.

@TDL2016 set out all you need to know. Either it's on your deeds (or the neighbour's deeds - get these online from the land registry) or the strong likelihood is it is jointly owned.

If it's jointly owned you can fix it. You can't demand your neighbours pay towards it but usually normal people agree to share the cost.

The red pen mark represents the boundary. If there’s no indication on the red line as to who owns the boundary then it’s likely jointly owned. It doesn’t matter who has the “pretty” side of the fence, this is no indication of who is responsible for the boundary or it’s maintenance.

I always thought the red lines indicate your boundary, the neighbour will have the same, you can look this up online.

Yep it’ll be in your TP1. There will either be a “T” mark on the plan annexed to the TP1 or the agreements and declarations section will have a statement in saying that in the absence of “T” markers the boundaries are party

We seem to share ours as there are no Ts on the info. We certainly shared costs when 1 side went down and will hopefully do the same on the other side as we have had a fence casualty with the recent winds.

Ours is to the right when facing the house but you couldn't tell apart from it is clearly on our side. But the one to the left is also on our side and we have the bad side of the fence as we put both up as got fed up with neighbour not putting anything up.
