Hello, my mother in law is Living with us for most of the year. We are British nationals. How do we get her the necessary paperwork to get her on the NHS and so she can’t be deported with brexit?

Completely dependent on where she’s from- start with googling name of country and right to remain uk.
It won’t be cheap.

Without knowing the country, it's difficult to advise. Is your home her residence too? Does she pay any bills, is she on the electoral roll? Does she work?

BoxedWine · 23/12/2019 17:54

Where is she from? If she's an EU national and physically present in the UK now she can apply for presettled status easily enough.

Thanks, she’s German so it should be free or not? Is it just filling in the pre settled scheme thing?

The NHS is a residence based system. If she is ordinarily resident in UK she is entitled to NHS care regardless of nationality.

Ordinarily resident would also imply paying income tax, council tax being on the electoral roll etc. It would also mean that she was no longer insured with a German Krankencasse.

BoxedWine · 23/12/2019 19:06

Where is she actually living? You say she's with you for most of the year, where is she domiciled? Where is home? It is possible to be ordinarily resident in two countries but more complex to prove.

Having presettled status wouldn't necessarily mean a person is ordinarily resident because you could get presettled status while you're only here for a very brief period. You literally just have to prove you're an EU national and physically in the UK as you apply and that's it.

where is her main residence, UK or Germany. Surely she can't be deported if she is a UK resident.
