Please can someone help me find the section of the booze licensing act which states a premises must serve a small glass of wine?

I'm in the middle of a complaint and need your bigger brains! Grin

I’m not sure where you stand if they only sell wine in pre packaged mini bottles, usually about 187.5ml.

If they sell by the glass though they should provide a small measure.

Provision of smaller measures
Providing smaller measures of alcohol can play an important part in making sure your customers can keep their consumption to a minimum, should they wish. According to guidance, the licensee or designated supervisor must make sure that there are smaller measures available for the following:
Beer or cider: Half-pint glasses
Gin, rum, vodka, or whisky: 25ml or 35 ml measures
Still wine: 125ml glasses

I've had a look into this and can assure you that our drink sizes are not against the law as this size of the portions are provided at the managers discretion.

Our pub only sells medium and large glasses BUT only charges a small glass price for the medium ...arguing that if you don't want to drink it all, that's your choice ... and if you do... then you done well.

@Bernadette yes, the menus only had 175mL & 250mL so I asked if they did 125mL the waiter said no so I asked if he was sure and could he check as the bar is meant to, he came back and said it was definitely only 175mL or 250mL

Hmm I bought 175mL as I wasn't 100% if the law had changed since I worked behind a bar. I've filled in the online complaint (hoping to get a credit note Grin) but I'm still being told I'm wrong

They should absolutely have a 125ml available. Easiest complaint would be to your local licensing department at the council if you want to you are right. The CB premises supervisor who holds responsibility for the licence should also be aware of this

OMG I've just had this reply:

I'm sorry to hear that you weren't able to choose the size of wine that you wanted, when wine is sold by the glass the law is a little more flexible as they can be sold as 125ml or 175ml, as a business decision we choose to offer the larger size of portion, you can find more information on this here: https://www.gov.uk/weights-measures-and-packaging-the-law/specified-quantities.

Yes, you are right. Keep fighting with them as despite this being an issue that realistically, rarely comes up, licencing law breaches can be really serious for them.

The government page you’ve linked to agrees with me too.

It’s really frustrating that you’d argue with a customer rather than research the topic and admit this restaurant was in the wrong, and it’s a really serious matter.

They replied:
I'm really sorry to see that the restaurant and bar team didn't provide you with the 125ml size when requested. I've passed on your feedback to our restaurant management team to ensure that this doesn't happen again. I'd also like to apologise as I can now clearly see that this is something we should have been offering.

I do hope that we can welcome you back very soon.
