CMS for more than one child

I have recently applied for CMS due to my sons father not sticking to our previously made private agreements. Since then I have spoken to the mother of his other two much older children (16 and 17) who states she cannot apply to CMS because of their ages, that they were born before 2003. Is this correct. Also If this is the case will they still be included in the CMS calculation?

That’s not right. If they’re not absolutely bonkers all 3 children will share between them 19%, give or take, of his gross income.

Unless they are in full time education studying for A-levels or an equivalent qualification their mother cannot apply for child maintenance through the CMS. If that is the case they will not be included in the calculation.

My ex has another son . His calculation does not include his other son as she doesn’t claim

Pp state that 19% will be slip between three dc if the other dc are in education.

Are the others in education?

If not, he can say he pays a family arrangement, say he tell them he pays the Ex £200 a month for the other two so the calculation will then still be split 3\19%, even if he isn't giving the money to the ex as she would have to prove she wasn't getting any.
