Solicitor has lost passport

I have recently sold my house. At almost the last moment the solicitor required me to nominate a trustee as, apparently, I couldn't sell the house myself.

I nominated my daughter and she sent documents as ID and proof of address, etc. On completion I asked about the return of documents and it was explained that the franking machine was out of order but they were sending the documents out that day by special delivery.

After waiting several days and receiving nothing I rang them again. They told me that they'd sent the passport to the address of the house I'd just sold. I checked with neighbours to make sure they hadn't signed for anything. Someone was supposed to be visiting the house because there were letters to be sent on. It took them a week before they actually did that but the outcome was that the passport wasn't there.

Initially they said they didn't have the tracking number but then gave us a number that Royal Mail says doesn't exist on their system.

We're now a month on they keep changing their account of what has happened and also don't seem to care that much.

The bottom line is that my daughter needs her passport back and we're getting no help from the solicitors. We need to step things up but we're not sure exactly how to go about it. Does anyone have any advice?

Well they don't have it and neither do you.

If they posted it tracked and the number doesn't work they need to speak to Royal Mail.

I would just go down the lines of they need to pay for the replacement.

It's clearly got lost along the way. Your daughter needs to get herself a replacement from the passport office. You can argue about who's at fault and who is liable to pay - that's a separate matter.

Your claim for replacement cost will be against the solicitor - it's up to them whether they counter-claim against Royal Mail.

I would write to the solicitor with a formal letter of complaint setting out the above, and difference in changes of account of what actually happened....tell them that you are looking to them to pay to replace the lost passport
