Property Order

Can I apply for a property order without a solicitor? I just cannot live with my ex any more, he swears and shouts at me frequently and I just cannot cope (I am having counselling and am trying ADs).

I have seen a solicitor but she isn't that helpful and it all takes so long. I don't know how long I can live like this. I am primary carer for our children but my ex is adamant that he is staying in the house. He says that he will buy another house for me to live in, but that would make me non-resident and I would lose child benefit (I buy all the kids clothes and shoes and do the majority of child care).

We have been through mediation and he just will not make any concessions. I have no idea what to do.

You can do anything without a solicitor, but the reason many people either use one or do nothing without one is because many people don't know enough about what to do.

For example, you don't say what you mean by a property order. That could mean almost anything. I'm guessing you're unmarried, but would you be issuing under the Trust of Land etc Act or the Children Act?

Are you married to your ex or is he an ex-partner who you were never married to ?

If partner , do you own any part of the house. ? Can't give much advice without that information. As different routes legally to achieve what you are after.

However yes you can apply for an occupation order yourself. I did so - and am not a lawyer. But not knowing the exact situation i, this may not be open to you.
