Interest on CM payments

Hi all, looking for advice. I’m due in court next week for a D50k hearing on child maintenance owed by my Ex. Quite frankly, I’m fed up to the back teeth with him messing me around and the knock on effect to the kids. I want to send out a clear message that our court order is legally binding and not changeable depending on his whim.

I am considering asking the judge if it is reasonable to add interest to the amount owed. Does anyone know what the interest rate is usually charged at or how it is calculated? Or AIBU?

For context, I am no contact with Ex and he is not a reasonable person who can be negotiated with.

Bump.
I’ve now been to court and judge found in my favour. (Ex did not turn up). Judge also added a further amount to the judgement that had arisen between the time of my application to the hearing.

Ex is still not paying so I’ve now applied for an Attachment of earnings order.

Does anyone know what I can charge in terms of interest?

Statutory interest on small claims matters is 8%. I would assume that as the maintenance is a debt owed to you then you should be able to apply statutory interest to the late payments, however, I don't do family law so can't confirm this for you.

Only on debt greater than £5k

Not certain about maintenance though, but the amount to be claimed would be so small that no one would be bothered paying a lawyer to research it for them.

Oh I see, thank you @Collaborate I’m so pissed off with my ex threatening and not paying that I’m just going to throw everything at him that I can. He needs a clear message that they are our children and they need financial support.

He owes £1100 and it’s been owed since September so I do feel inclined to add 8% to the amount.

I’ve applied for Attachment of Earnings order so hopefully if this is accepted I’ll have no further grief.
