Getting mistakes changed on medical records

LOVELYDOVEY05 · 22/10/2019 15:41

My Gp has made 2 mistakes on my record which I can prove are wrong. I have written to compkain but what are my rights to getting these changed and the truth written. I am not very pleased

Data Protection Act says information held about some one has to be accurate, up to date and relevant.

Wait until you get a response from you GP. If they make the corrections you want them to, then all good.

If not, explain to the CAB/Google/a legal person what has happened and what you want to happen next.

Medical records can be exempt from total removal of inaccurate data BUT your GP should include a note describing and updating the information.

From the ICO:

Example*
A doctor finds that a patient has a particular illness and notes it in their medical records. Sometime later, this diagnosis is found to be wrong. It is likely that the medical records should include both the initial diagnosis and the final findings because this gives an accurate record of the patient’s medical treatment. As long as the medical record contains the up-to-date findings, and this is made clear in the record, it would be difficult to argue that the record is inaccurate and should be corrected.

What are the inaccuracies, and is the GP disputing them?

ToEarlyForDecorations · 23/10/2019 11:36

There's an inaccuracy on my medical record. I disputed this and pretty much got told, 'because I said so because I'm the doctor and I made the diagnosis.'

This same doctor actually said, whilst smiling, 'go back and see your friends at the public referral clinic if this occurs again.'

I think the diagnosis has been quietly dropped from my record. I don't want to ask in case it is and they think I'm making sure it's on my record.

I am not pleased as I plan to move in a few years and it could impact on me negatively if a new doctor reads this in the future ie have a effect on later treatment for example. The mistake was made by a hospital and reported to a GP who then more or less suspended my treatment to be taken once home on the basis of the inaccurate info. This is not very good .Oddly I have paperwork which proves it incorrect

Can you be more precise/detailed OP? I doubt that it will be outing, but it will help clarify whether it’s something you can ask to have amended.

I got asthma removed from mine. I've never had asthma, I had an inhaler once when I had pneumonia. For some reason they kept putting asthmatic and inviting me for an asthma review. Or a flu jab for "your asthma"
I got that frustrated I went to one, blew some stupid high reading on the peak flow, the nurse went "er you're not asthmatic? Never seen you before, and you don't use inhalers?"
Me "no. But try getting it removed off your records!"
It got removed Grin
