Phone insurance- is this legal?

I have mobile phone insurance with loveitcoverit. When I took out the policy they required a photo of the phone with the IMEI number showing. I sent this and they accepted it and my phone was ostensibly insured.

Yesterday I dropped my phone and the screen has smashed. I contacted the insurance company and they are now requiring a proof of purchase with the IMEI number showing. This I do not have as it was bough SIM free from Amazon as a Christmas gift. I also recently had a clear out and chucked the box away (typically!) So I have no way of providing a proof of purchase with the IMEI number showing and will be unlikely to be able to claim. Surely they should have checked that I had this before they contracted to provide insurance for the phone. They have been taking my money every month, but in that time I have never been in the position to be able to make a successful claim since I cannot provide the evidence they need.

I know I messed up by not checking the Ts and Cs properly, but if it's impossible for me to claim is it actually legal for them to offer me insurance? Has anyone got any suggestions as to how I can make a claim?

Perfectly legal. If they had advised you that the policy was suitable you would have a case. However, my understanding is that they don't offer advice. It was therefore up to you to ensure that the policy would meet your needs and cancel it if it didn't.

In your shoes I would try claiming with the information you've got and see what they say. I have no experience with them but it may be that there is some flexibility. If not, once you've exhausted their complaints process you could try the Financial Ombudsman Service.

It’s perfectly legal and within the T&C you agreed to when you signed up I’m sure.

Can’t you just ask the person who bought you the phone as a gift for the proof of purchase? It’ll be in their amazon order history and they will easily be able to screenshot it and send it to you.
