Would you take this to small claims court

My ex and I used to work together in a business. Limited company in my name only. He acted as a self employed representative/contractor for the business.

He often met with clients to finalise details and we had agreed methods of payments. I discovered that he had asked several clients to pay or part pay either in cash or direct to his bank account.

In total this figure came to around £8500. This was around 3 years ago. Last incident of keeping client money was last September.

He acknowledged in writing that he needed to pay this back. We briefly got back together after a 3 month separation but we subsequently split for good and he has not paid anything back since. He became abusive and was convicted of stalking/harassment with a non molestation order in place etc.

I want to take him to court on behalf of the business, to recover the money but am not sure if i can do that via small claims or not? Or even if I should? My business has suffered greatly as a result and It's not really recovered if I'm honest. Any advice?

Yes, you can use small claims for this. As for whether you should or not, the question is whether he is able to pay it back. There is no point taking action against him if he hasn't got the money.

He has recently come into an inheritance so yes I believe he can
