Paternity fraud

I am looking for advice for my brother. He and his girlfriend have been raising their son together since he was born last year, however they have recently split up. He was encouraged by my dad to have a DNA test ‘just to prove my dad wrong’ as he’d had doubts about his gf (another post altogether!) and lo and behold my brother is not the biological father to the boy he’s raised and loved for almost a year.
My question is, does he now have any legal rights to his ‘son’? He is on the birth certificate. Would he stand any chance of being able to see him still? His ex is furious with him for having the DNA done (and uncovering her lie!) and is saying he can’t see the baby anymore. My heart is breaking seeing how devastated he is. He still loves the baby the same as he did before!

what shes done is illegal (birth certificate). I dont know about access,but i can imagine she will make life difficult

Does the ex gf realise your DB can legally stop all maintenance payments now that he isn't the biological father? Regardless of birth certificate. If this is pointed out to her maybe she will reconsider her threat?

@carly2803 Please explain what the mother has done that is illegal. OP’s brother was presumably a possible father otherwise he would not have consented to go on the BC. Just because the mother picked the wrong father to enter on the BC doesn’t make her a criminal.

It might be illegal but would be impossible to prove that she knew he wasnt the father.

Sorry, @Firsttimekittenowner , but @Carly283 must be right as she’s used an exclamation mark, and must know the mother in question even though this is an anonymous message board. And of course the fact that OP’s brother must have had sex with her around the time of conception doesn’t at all mean that the mother won’t at least have wondered whether he was the father.

Nothing in the OP’s post suggests the mother knew. She may have know . She may not. She probably just hoped for the best. It is ‘t Something that can be proved, is it?
