Tenancy Agreement

My son is in a shared house with an agreement for the LL to pay the utilities. This does form part of the contract. Yesterday one of the other tenants opened a letter addressed to the occupants of where he lives which was from an energy firm threatening court action over the 10k unpaid gas and electric. This morning a 'for sale' sign has gone up. My son is at college in a different city to ours and has a job where he lives so if things go south he can't just move in with us.

What I want to know is if he manages to secure work near us and a place on the same course at a local college is he able to terminate his contract early as the LL is not fulfilling their obligation or will he have to continue paying the rent?

How long is the tenancy for? Sounds like the house is close to being repossessed.

He is in his first six months. Ends December

If he’s paying his rent to a lettings agency rather than direct to the LL then they should provide some clarification.
Otherwise I think I would approach the estate agent and explain that he’s living there with a tenancy agreement in place until December to see if they’re aware,

It's unlikely he can break early based on what you have said. As yet the unpaid utilities is having no effect on him and the landlord is entitled to sell the property if they wish.

@TinchyP if the LL gets repossessed it will have an impact and if utilities get stopped it will.

He pays direct to LL. Agents were just tenant finders.

I know I might be worrying unnecessarily but he's 18, he's had a really shit few months due to his Dad and it's hard to help him from 50 miles away.

But neither of those things have happened yet. All you know is that a for sale sign has gone up - it might be nothing to do with a repossession. Is the lease agreement an AST? It can be very difficult to break and AST even when the landlord is in breach.

They should ring and tell utilities address of ll and that they are tenants. Also double check the agreement that their rent is inclusive of all utilities then it might be worth giving Shelter a call.

@TinchyP I understand that. I'm not saying he should get out of the tenancy I'm just looking at all options so I know which route he has to go if the property is repossessed. I work in mortgage services so know that side of things it's just that it doesn't look great having the property up for sale and receiving that bill.

@LIZS never thought about Shelter. I will message him and ask him to do that.

Have double checked his tenancy agreement. Definitely confirms utilities are included.

Also the agents have said that if utilities are switched off he'll still have water!
