Notice period - is it legal?

I am sure its legal mightly unfair. My contract says I have to give my work 12 weeks notice. But they only have to give me 4 weeks.

They also don't pay us company sick pay, not that I am bitter.

But you signed the contract ? Lots of companies don't pay any more than SSP. Stops employees taking the piss if they only get £88 per week rather than their full salary.

It's not good practice, but it's perfectly lawful.

If your statutory minimum notice period you are entitled to from your employer is higher than the contractual one, then the higher statutory minimum is what you would get.

So if you've been employed 6 years, for example, you'd get 6 weeks' notice from them if they dismissed you, even though your contract says you'll only get 4.

Despite it being legal I think it’s just mean. It puts me off working there even more. Unfortunately the job I have gone for wants someone pretty sharpish and I have a long notice period. Which isn’t too unusual at my level.

I have worked in lots of places but never anywhere which only pays SSP or one that is unfair in its notice periods. Trust me I have worked in loads of different type of business. I am never really off sick so hopefully won’t suffer on that policy.

It's been 3 months in all jobs I've had for the last 15 years. Pretty standard.

It wasn’t the 3 months notice my end. I have had that for lots of years too. More the fact they won’t reciprocate so if I got made redundant they only need to give me 4 weeks notice. Oh well, too late to argue the toss now.
