Hello,
I rented my flat 3.5 years ago.
I found out a year ago that my landlady was in court with her brother over ownership of the flat.
I have just got letters from the brother with photocopies including a ruling in his favour - the flat is now his, not my landlady's.
I have cancelled the direct debit for the rent for the coming month (just in time) - but I don't know what to do.
This new guy wants me to simply set up a direct debit in his name.
He also wants to come and check out the flat.
However, my contract is with his sister.
What do I do?
I do not want to sign a new contract as I want to move and don't want to tie myself down for 12 months.
I have said to come round and see the flat and talk on Friday morning.
Advice please on what to do!

My questions are also:
What if my (ex)landlady appeals?
What happens to my deposit?

Forgot to say that the original contract was for 12 months and is now rolling - one month notice for me 2 for them

The depost should be transferred or returned to you - but it doesn't look like you've heard from the landlady at all about it, so you could contact the deposit scheme yourself because I'd assume that your contract with the landlady has ended.

How soon do you want to move?

Mythologies · 30/07/2019 18:50

Thanks for replying *Chic.
I haven't heard at all from the landlady.
I got an email saying my deposit had been transferred - hopefully still safe - I did everything through an agency.
Will track them down.
I can't move for at least three or four months - could be longer, but hopefully by Christmas.
How would my contract have ended?

Your contract hasn’t ended.

Assuming the brother is correct (sounds like it if the deposit has been transferred!) then your tenancy has just been transferred to the brother.

So your tenancy continues with him as your landlord.

Pay the rent to him, keep a record of it. Give your one months notice when you want to move.

There’s no need to sign a new tenancy - you have a statutory rolling tenancy.

That sounds reassuring Avocado :)
I am checking with the deposit scheme now to see who it was transferred to.
Should have checked at the time.
My only worry is that the deposit was transferred in March - but the ruling was last week.
Will know more tomorrow.

Ok
I have managed to log in to the deposit account - it is now registered to a lettings agency.
This may have had more to do with the original agency closing that the court case - but sounds as though the money is still there.
Will call them them.
From what you say @AuntieAvocado, it is simply business as usual - for me at least?

Yes definitely - it’s just the same as if your landlord had sold the flat, and your tenancy just carries on.

Mythologies · 01/08/2019 11:52

@AuntieAvocado
Thank you!!
I was so worried.
New landlord's son is coming round tomorrow and I will pay the rent and set up dd.
Contract says pay rent on 2nd of month, so that all fits and I can stop worrying
Thanks again for taking the time to reply

Update
New landlord's son came round to check the property.
He said
I would have to sign a new contract as a court order was different from selling
I said no and it wasn't
He said I would have to pay from the court ruling and ask for the money back for the overlap from old landlady
I said no - sort it out between you - I paid the rent
He said I would have to ask for my deposit back and pay a new one
I said no and showed him the deposit certificate
He then said - oh ok then.
Hope that is the end of it.
What a palaver!
