I have split with ex but still having to live together. However he has stated letting out the loft room with Airbnb whilst we are still there. Not only is he keeping all the profits. This is also a massive safeguarding risk. He is inviting strangers into our home without my consent. The children are young and we don't have locks on the doors. I have contacted Airbnb but they are being very apathetic. The house is jointly owned by us as tennants in common.

Keep putting pressure on Airbnb. The trick is to prove that he is breaking Airbnb rules. As you are joint owners then you not agreeing will break their rules.

Who is paying the mortgage and other outgoings on the property?

It seems to me that if you are concerned for the safety of your children this might be something that a court might want to prohibit on an application under the children act.

Under the terms of your mortgage this kind of sub letting may well be prohibited too. Do you have a solicitor?

In this situation I would simply not let anyone enter my house. Stand at the door and shout "get out" until they leave. What have you got to lose?

Don't let guests in. Shout at them to leave or you will call the police. They will leave a bad review and the listing will be removed.

Your partner is invalidating the property insurance, both contents and buildings. He is also probably breaching the mortgage terms and conditions. Your local authority may also have planning restrictions re airbnb. He should also be accounting to you for your share of the profits. He is putting your children at risk and I agree with Collaborat an application to court for a prohibited steps order would be appropriate. You can do this yourself. I believe you need to complete form C100 which you can obtain online at hmcourts service. Check the terms and conditions of your mortgage and house insurance and include these in the application as well if they are being breached.Post again if you need more help.

Also is the loft room properly habitable (meets building standards - fire doors, stair case, fire escape as appropriate) or just a loft that’s been boarded out with a bed put in?

If there were a fire for example, would your insurance still be valid?
