Money back from divorce

My divorce became final 3 weeks ago. I paid all costs and the court has agreed that my ex husband needs to pay me back the £550 for the divorce. I spoke to my solicitor about getting this money and she said all I need to do is ask him. Well that went down well because he laughed in my face and is refusing to give it to me.

Has anyone else had this problem? If so what can be done to get the money back?

Keeping in mind I am a single mum of 3 with a very low income therefore I can not afford to get another solicitor to take him to court

Thank you

Presumably you have this documented in the order?

Deeks · 12/07/2019 12:17

Yes. The court agreed and stamped the paper work to show he should pay me back but he wont.

What does the order actually say?

Have you reported back to your solicitor the outcome when you followed her advice and it wasn’t successful?

I told my solicitor at the time and she advised it's not worth going to court because it would cost a lot.

My divorce papers show that the respondent needs to pay me the divorce fees.

If it's documented in a sealed court order then Small Claims would seemingly make sense and be the cheapest option even if it is £60

If the court has said he needs to pay you £550 you have a quantified costs order. You merely need to enforce it (don't go to the small claims court).

Best way to enforce these is always to issue an application for warrant of execution. The court will send a bailiff round to recover the debt, and the cost of the bailiff and the summons will be added to the debt collected. I bet he won't laugh at the bailiff when he takes walking possession of his laptop, car or TV.
