Using phone whilst drive to video evidence

Hi

My husband has just returned from work having witnessed a car crash in to another, and drive away. There was damage to both vehicles.

Rather than just give his details to the victim car for their insurance, he has videoed the offending vehicle drive away whilst driving himself using a handheld mobile phone.

He has genuinely tried to do the right thing morally but he is unimpressed that I have said that it gave him no right to use the phone to video (done calmly and safely from footage) and that legally, his offence, the use of the phone whilst driving, may be seen as almost as significant as the offending vehicle for not stopping.

He thinks I am being ridiculous?

Well the footage he has will prove he committed an offence. As to comparative seriousness I couldn't say.

You're right OP, intentions do not matter - he's committed an offence so I'd expect the police to pursue it if its submitted as evidence

It's a hard one. As I know why his done it but it is legally wrong.

I was reversed into 3 times by a HGV. I was stationary behind it, about 2 cars length away. I didn't have time to move as cars were behind me. It basically reversed and hit me and stopped, then decided to reverse and stop another 2 times and then drove at speed towards the junction. I proceeded to film it whilst my engine was on and it was used as evidence as the driver denied I was there. I didn't get into trouble though it did cross my mind. But then I wasnt driving as such. But still I shouldnt of had my phone in my hand when the engine was on!

Its a shame really. I understand the hazard of phones at the wheel, but they can be pretty helpful in terms of getting evidence when you really need it

if he wants to be a traffic vigilante then tell him to buy a dash cam.
And if he is so convinced he has done no wrong he'll pass his footage right to the police asap won't he?

I wouldnt pass the footage on. He could just tell the police what he saw, give them the car regs etc but he doenst have to provide them with the video footage - as it may well be used against him

I would give the police information from the video and then delete it. The police will just charge him for doing the right thing.

He used his phone whilst driving. Giving the footage to the police is coughing to the offence! Just give a witness statement, and tell him not to do it again.

He can just give the footage to the driver or his insurer. The police won't give a toss about a little accident
