Council tax non payment

Trying to assist a friend who is unwell and seems to have no gravity on the situation.

He hasn't paid his council tax since January. They have been to court and have a liability order. He didn't attend - do you have to?

They have now sent him a form to complete for an attachment of earnings order, but this was a few weeks ago. He hasn't completed it, even though he is perfectly able to pay, he just can't cope with the idea of sorting it out and is too independent to get help.

What will be the next stage?
And how long do I have to persuade him to sort this out?
What's the worst it can get? They can put you in prison, can't they?

If he can pay, can't be just give you the money, the CT letter and pop to a paypoint?

stillawakeat4amagain · 19/06/2019 15:43

They can ask for the money monthly from his employer too

Just very independent and struggling with health. He really won't. I only saw the information accidentally.

When I say afford, he now has to pay the whole year plus Jab-April, which he can't do outright.

I know it sounds so simple doesn't it?

I wanted to know what actually happens so I can try to get through to him how important it is, as he is just expecting it to go away.

@stillawakeat4amagain they have sent him the form for this information but he has ignored it, can they do it without him providing the information?

They will do an attachment of earnings order. There is some shame as your employer is made aware that you haven't being paying

catlady39 · 19/06/2019 16:33

Can they do this without him actually completing the information though? If he doesn't tell them who the employer is, will they take worse action?

Bailiffs is the next step.

I work for a council. If he contacts them and tells them he can’t afford to pay the full bill but can afford it in instalments they’ll set up a payment plan.

If he just ignores it he’ll be put on a list to be checked with the DWP & HMRC for any benefits or earnings and a deduction from benefit/earnings order will be sent.

If nothing comes from that it’ll go to a debt collector.

stillawakeat4amagain · 19/06/2019 22:44

Yes as pp said they will find out where he works but he can set up affordable payments as long as he keeps to them nothing more will happen.

catlady39 · 19/06/2019 22:47

Ah so they can find out where he works and setup an order and it'll all be sorted? He can afford that, I just can't explain how impossible he is at sorting these things out.

Think it more likely to be bailiffs because if he hasnt told where he works how would the court know?
