Claiming UC on a 50/50 arrangement

My exH and I only have an informal arrangement regarding our 50/50. He receives CB (as it was convenient at the time) but he's refusing to pass it on to me so I can claim UC. There's no clear primary carer as our DD is registered at both addresses for school, mine at the GPs and his at the dentist. I've called different organisations (like CAB and turn2us) and they both said I need CB to claim UC. Working families doesn't think so and is looking into it. Any words of advice?

If you are not claiming CB then you can't add your DD onto your universal credit claim. If you are low income you may be able to claim UC anyway, but without the dependent element you won't get a lot.

We're not considered low income because we both work FT. A joint income of £37k is seen as enough for a family of 3.

I'm only interested in the childcare element as the only thing I want is to be able.to afford to work.

They haven't asked me about child benefit for my universal credit claim, I'd just apply and see what they ask for. It may be that you have to go to court to get the child benefit handed to you if you can't claim any childcare costs on 50/50 because obviously you need it to work.

Yes Mummy court was the suggestion of CAB but I wouldn't get any legal aid. People who have been through court heavily discourage it as well.

With that income it's unlikely you would get anything anyway as your wages will reduce the whole uc award including child element. I'm not even sure if you would get help with the childcare costs :/
