Trademark infringement

I am a teacher with a resource sharing website (ie. PowerPoints and worksheets). Resources are all free because I make money through adverts on the website. Without the traffic to the site, I would not be making any money and would have to charge for the resources.

The website is well-known in the teaching community and widely used across the world, as well as in the UK.

Where do I stand if I am registered as self-employed, with a registered trademark and someone is using my logo and resources without my permission? (Therefore diverting traffic and revenue from my website).

I'm hoping to speak to a commercial solicitor in the morning but was wondering if anyone knows anything to put my mind at rest tonight.

  • copyright infringement
  • trademark infringement (very helpful your trademark is registered)
  • solicitor will probably write a cease and desist letter requiring them to stop the use, delete copies etc
  • you would have a claim for compensation if you have suffered loss as a result of the infringement
