Who is liable for this damage?

We own a house which has a shared driveway with the next door house. Our property is a rental property we let out. At the time of this incident, the property was empty and having some work done. NDN has kept a car parked on the shared drive. It says in deeds to not keep items on the shared drive - this has been a bone of contention in the past.

NDN has had some damage done to this car. They believes it was the contractors working on our property as it apparently occurred during this sort of time. We have not seen the damage in person, only a photo and they have said they have no proof it was our contractors.

Who is responsible for covering the cost of the damage? Should we be doing anything about this? We have landlords insurance but only very basic cover as the property was vacant but being renovated.

The contractor should have their own insurance, but if the neighbors cannot prove they caused the damage they will probably have to claim on their own

If they dint know how / when / where / who did it then it's tough and they will have to sort it out themselves.

Them I would say.
They were doing something they shouldn’t (so I would say that excludes you from any joint liability) and something happened but they can’t prove who did it (so excludes contractor who won’t pay without any proof)

It's nothing to do with you. They can argue with the contractors.

All sounds a bit vague. He can’t prove it. Either ignore the request for payment or say you’re sorry this has happened but you’ve asked your contractors and they say it wasn’t them. If it was your contractors, that does not make you responsible anyway. Sounds a little like he’s trying to pull a fast one.

If no one saw the damage being done then it's tough. You can't expect someone to pay in spec that it might have been them. Anyway, it's nothing to do with you, it would be the contractor's liability.

Anyway, it sounds like they're pulling a fast one, they could have damaged their can anyhow and any time. Tell them to jog on!

It's the contractor's problem. Pass the details on to the neighbour and forget about it. They can argue with them or their insurers.

Thanks everyone. We were thinking it's not really anything to do with us. NDN turned up at our house (we've never told him where we live but we knew he had a rough idea - it's fairly close by) demanding the names and addresses of everyone who worked on the house. When my DH said he didn't know, we only know the company and the name of the guy in charge he didn't believe us and made some vague comment about "Who knows what might happen". DH thinks he was filming the conversation too.

Needless to say we are putting CCTV up, and will phone the contractors this morning to let them know he's on the war path.
